ON HB21-1160 and how it would hurt rescues trying to save pets like Zena. In Section 2 (4) it states:

“EACH ANIMAL SHELTER AND PET ANIMAL RESCUE SHALL PROVIDE EACH DOG AND CAT HELD IN ITS CUSTODY WITH TIMELY VETERINARY CARE TO ADDRESS AND PREVENT UNNECESSARY OR UNJUSTIFIABLE PAIN AND SUFFERING”

There is no clear definition of “TIMELY” nor the particulars of

“VETERINARY CARE TO ADDRESS AND PREVENT UNNECESSARY OR UNJUSTIFIABLE PAIN AND SUFFERING”

The risk here is for small, rural and underfunded shelters and rescue to address this in a way that avoids PACFA punishment for noncompliance. Many organizations are in areas with little or no veterinarian to provide them with immediate care.

These organizations work tirelessly, often without pay, to address the needs of the homeless pets in their care. If it will take longer than whatever “timely” means, they will be out of compliance. And then is the choice that I can risk taking care of this pet to the best of my ability or if I euthanize the pet, it clearly in compliance with this law.

We should not be putting lifesaving organizations in the is position. In order to avoid being in this position, they will need to find funds, which is either tax revenue increases or finding donations that are not available.

The cost of complying to undefined violations to this bill poses a risk to PACFA organizations in the form of fines and/or license seizure or restrictions. The Fiscal Note states "When violations are noted during an inspection, licensees are expected to correct them." AND "The bill may increase revenue from fines for violations." PACFA organizations will require more public funds or kill treatable pets.

There is no authority from PACFA to give guidance to licensees. This puts current PACFA licensed shelters, rescues and staff in potential jeopardy of revocation or legal ramifications. The authority to give direction on these definitions is not clear in this bill.
